Jak to tehdy bylo a co dělají dnes?

V komentáři pod postem Vojtěcha Šimíčka Chvála banalit jsem podotkl, že by mohlo být zajímavé natočit nějaký dokument o osudech lidí, jejichž případy pomáhaly vytvářet evropské právo. Zaujala mne proto kniha Michaela D. Goldhabera A People’s History of the European Court of Human Rights (Rutgers University Press, 2007).

Její autor se vydal po stopách některých slavných (a vesměs nikoli banálních) případů projednávaných v minulosti Evropským soudem pro lidská práva (ESLP), aby čtenáři nabídl pohled na významné judikáty ESLP z trochu jiného pohledu.

V první kapitole narazíme na případ Marckx proti Belgii (rozsudek ze dne 13. června 1979 ve věci stížnosti č. 6833/74), v němž ESLP dospěl k závěru, že tehdejší belgické právo neuznávající automaticky rodičovství neprovdané matky k dítěti, které porodila, a stavící nemanželským dětem do cesty další překážky, kterým děti narozené v manželství čelit nemusejí, porušuje Úmluvu.

Nuže, co dělají a jak se mají dcera, matka a jejich právní zástupkyně dnes?

Today, Alexandra Marckx is well into her thirties. She bumps into her natural father at the supermarket from time to time, but he is not a part of her life and never has been. After travelling the world as an au pair, Alexandra studied dog grooming and photography. Now, with her mother, she is an Internet entrepreneur – they run a Web site called petsandgo.com that offers advice for traveling with pets.
The octogenarian Paula Marckx holds down two jobs, as a Web entrepreneur and as a public relations executive for Antwerp’s airport. The Web site evolved out of a book on traveling with pets that Paula published on a dare. She still occasionally gets behind the controls of an airplane and has recently published her memoir.
Thirty years of practicing divorce law have very much confirmed Moni Van Look’s views on marriage. She still lives in unwed bliss with her boyfriend, Josse Van Steenberge, who became the dean of the University of Antwerp. They had three children together – all of whom, obviously, stand to benefit from the
Marckx ruling. Moni’s second son learned about Marckx in civics class, but being a cynical teenager, he didn’t volunteer that it was his mother’s first big win.

A dovolte jednu machistickou poznámku: fotografie v knize prozradí, že z „malé Marckxové“ vyrostla opravdu pěkná žába, pardon, dáma. ;-)

Nu a co třeba Jeff Dudgeon a jeho přátelé, kteří se v roce 1975 sešli na první schůzce Committee for Homosexual Law Reform in Northern Ireland a kteří jistě mocně oslavovali úspěch svého předsedy ve strategické litigaci Dudgeon proti Spojenému království (rozsudek ze dne 22. října 1981 ve věci stížnosti č. 7525/76)? Tak třeba Richard Kennedy ...

Richard has maintained his rebellious sense of humor. For several years, he ran an organic bakery in London called Marie Antoinette’s, where he continued to sell double chocolate mousse cake. He announced himself a heterosexual in 1988, upon which he lost his life presidency of the Northern Ireland Gay Rights Association. “Before I die,” he jokes, “I have to be a dyke.”

Zajímavá je i zmínka o uličníkovi Tonym Tyrerovi, jehož proslavily tři rány rákoskou uštědřené jeho holé zadnici za to, že spolu s dalšími třemi chlapci napadl staršího spolužáka, jenž je udal, že si do školy nosí pivo, čímž všichni zúčastnění dali příležitost ESLP rozvinout v rozsudku ze dne 15. března 1978 (ve věci stížnosti č. 5856/72 Tyrer proti Spojenému království) teorii evolutivní interpretace Úmluvy („Úmluva je živý nástroj ...“):

Strasbourg’s ruling provoked a backlash from the start. When he was a schoolboy, the British judge Gerald Fitzmaurice wrote in dissent, getting caned was a matter of pride. Even the nominal applicant seemed to agree. Tony Tyrer sought to withdraw his case early on, but the European Commission on Human Rights ruled that the general question merited a hearing. Tyrer declined repeated requests to cooperate with this book. According to family friend Susan Kelly, Tony Tyrer always believed that being birched put him on the straight and narrow. “[H]e felt the sentence was justified,” says Kelly, “and was totally mystified and annoyed about the whole matter.” For better or for worse, the European Court of Human Rights has shown a willingness to get out ahead of local public opinion on certain issues, perhaps even ahead of the plaintiff’s opinion.

A také my máme v knize své zástupce. Autor prokázal značnou míru intuice, když se vydal i po stopách ostravských romských dětí ještě v době, kdy s Českou republikou prohrávaly po prvním kole 1:6 na body (rozsudek ze dne 7. února 2006 ve věci stížnosti č. 57325/00 D. H. a ostatní proti České republice), aby ji následně v odvetě rozdrtily 13:4 (rozsudek velkého senátu v téže věci ze dne 13. listopadu 2007).
